GETTRADESTREAM MASTER SERVICE AGREEMENT & TERMS OF USE

1. THE SERVICE & NO AGENCY
GetTradeStream (“the Company”), owned and operated by Jacob Mogielnicki, provides a Software-as-a-Service (SaaS) platform utilizing Artificial Intelligence (“AI”) for lead qualification, automated SMS communication, and invoicing. User acknowledges that the AI is a generative tool and assumes responsibility for verifying all AI-generated messages.
2. SMS & A2P 10DLC COMPLIANCE (DISCLOSURES)
User and Lead acknowledge the following regarding SMS communications sent via the GetTradeStream platform:
SMS Use Case: GetTradeStream sends automated marketing messages, lead qualification prompts, and AI-assisted booking alerts to facilitate roofing service inquiries.
Opt-Out Instructions: You can cancel the SMS service at any time. Just text "STOP" to the mobile number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
Customer Support: If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected] or 1-888-365-9312.
Message and Data Rates: As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Carrier Liability Disclaimer: Carriers are not liable for delayed or undelivered messages.
Age Restriction: You must be at least 18 years old to use this service and opt-in to SMS communications.
Activation Fee: A non-refundable $997.00 setup fee.
Subscription: A recurring $497.00 monthly SaaS access fee.
Software Optimization Bonus: User agrees to pay a 5% Software Optimization Bonus on the gross contract value of any project closed where the lead was managed by the platform. This is a performance-based software fee, not a claim-adjusting or referral fee.
5. ANTI-CIRCUMVENTION & AUDIT RIGHTS
Any lead first engaged by the AI remains a “System Lead” for 18 months. Failure to report Gross Contract Value results in the 5% Bonus plus a liquidated damages penalty of $2,500.00.
6. ROOFER COMPLIANCE (USER WARRANTIES)
User represents and warrants: User holds all required state and local licenses; User will not “waive” insurance deductibles; User will not represent themselves as a Public Adjuster unless licensed.
7. LIMITATION OF LIABILITY
Company’s total liability is limited to the amount of the last 3 months of subscription fees paid by the User.
